Terms and Conditions

Welcome to Leneex. These Terms and Conditions (the "Terms") govern your access to and use of the website at leneex.com (the "Website"), the client area, and all hosting, virtual server, domain, SSL and related services provided by Leneex (the "Services").

In these Terms, "Leneex", "we", "us" and "our" refer to LENEEX CLOUD LTD, a company registered and operating under the laws of the Republic of Cyprus, with its registered office at Themistokli Dervi, 41, HAWAII NICOSIA TOWER, 2nd floor, Flat/Office 201, 1066, Nicosia, Cyprus. "You", "your" and "Customer" refer to any person or organisation that creates an account, orders or uses the Services. A "Consumer" is a Customer who is a natural person acting for purposes outside their trade, business, craft or profession.

By creating an account, placing an order or using any of the Services, you confirm that you have read, understood and agree to be bound by these Terms and by the following policies, which form part of these Terms:

If you do not agree with these Terms, please do not use the Services.

1. Eligibility and Your Account

1.1. To use the Services you must be at least 18 years old and have full legal capacity to enter into a binding contract. If you register on behalf of a company or other organisation, you confirm that you are authorised to bind that organisation to these Terms.

1.2. You agree to provide accurate, current and complete information when registering and to keep it up to date. We may ask you to verify your identity, payment method or contact details at any time, including before activating an order. We may refuse, delay or cancel an order if verification is not completed or if the information provided appears to be false, incomplete or linked to fraud.

1.3. You are responsible for keeping your login details, passwords, API keys and SSH keys confidential, and for all activity that takes place under your account. Please notify us immediately if you suspect unauthorised access.

1.4. One person or organisation may hold several accounts only with our prior consent. Creating accounts to avoid a suspension, termination or restriction is not permitted.

2. Our Services

2.1. Leneex provides the following Services, as described on the Website at the time of your order:

  • Shared / Web Hosting — hosting space on servers shared with other customers;

  • VPS / VDS — virtual private and virtual dedicated servers;

  • Domain Registration — registration, renewal and transfer of domain names through accredited registrars and registries;

  • SSL Certificates and Licences — SSL/TLS certificates, control panel and software licences, and other add-ons.

2.2. Specifications, resources, features and prices of each plan are those published on the Website or shown in your order at the moment of purchase. We may improve, update or change features of the Services from time to time. If a change materially reduces a paid Service during your current billing period, we will notify you in advance.

2.3. A Service is considered delivered once it has been activated and access details (such as control panel login, server IP address and credentials, or confirmation of domain registration or certificate issuance) have been made available to you in the client area or by e-mail.

2.4. Domain names and SSL certificates are provided through third-party registries, registrars and certificate authorities. Their own rules and agreements (including ICANN policies and the relevant registry policies) also apply to you, and we cannot guarantee that a particular domain name will be available or that a certificate will be issued.

3. Customer Responsibilities

3.1. Content. You are solely responsible for all data, files, websites, applications, software, e-mails and other content that you or your users store, transmit or make available through the Services ("Customer Content"). We do not monitor Customer Content in advance, but we may review it when we receive a complaint, a legal request, or when we reasonably suspect a breach of these Terms.

3.2. Unmanaged services. Unless your plan expressly includes management, VPS and VDS servers are provided on a self-managed basis. You are responsible for the operating system, software installation and configuration, updates, security hardening, firewalls and monitoring of your server.

3.3. Backups. Although we may perform backups of certain Services for our own operational purposes, backups are not guaranteed unless they are expressly included in your plan as a paid feature. You are responsible for keeping your own independent and up-to-date backups of all Customer Content.

3.4. Security. You must keep your software, scripts, plugins and credentials secure and up to date. A compromised account or server that affects other customers, our network or third parties may be isolated or suspended immediately, as described in the Abuse Handling Policy.

3.5. Compliance with law. You are responsible for ensuring that your use of the Services complies with all laws that apply to you and your users, including laws on data protection, consumer protection, intellectual property and export control.

4. Acceptable Use

4.1. Leneex supports a free and open Internet and we want our customers to build and grow their projects with us. At the same time, we have zero tolerance for illegal or harmful activity. Any use of the Services for illegal purposes is strictly prohibited and will result in the suspension or termination of the affected Services and of your entire account.

4.2. You must not use the Services, directly or indirectly, to host, store, transmit, promote or facilitate:

  • a) any activity that is illegal under the laws of the Republic of Cyprus, the European Union, the country where the server is located, or the country where you or your users are located;

  • b) child sexual abuse material or any content that sexualises minors — such cases are reported to the competent authorities without notice;

  • c) content that infringes copyright, trademarks or other intellectual property rights, including pirated software, media or "warez";

  • d) phishing, fraud, scams, fake online shops, pyramid or Ponzi schemes, or impersonation of other persons or organisations;

  • e) malware, viruses, ransomware, botnets, command-and-control servers, exploit kits or other malicious code;

  • f) unsolicited bulk e-mail (spam), mass messaging without consent, or the operation of open relays or open proxies used for abuse;

  • g) denial-of-service attacks, port scanning, brute-force attacks, vulnerability scanning or penetration testing of systems you do not own or have no written permission to test;

  • h) unauthorised access to, or interference with, any computer system, network or account;

  • i) content promoting terrorism, violent extremism, or inciting violence or hatred against individuals or groups;

  • j) the sale or distribution of illegal drugs, weapons, stolen data, counterfeit goods or other illegal goods or services;

  • k) doxxing, harassment, stalking or the unlawful publication of personal data;

  • l) any activity that places an excessive load on our infrastructure or degrades the service for other customers (see Section 5).

4.3. Cryptocurrency mining and similar resource-intensive computations are not allowed on Shared Hosting. On VPS/VDS they are allowed only where the plan expressly permits it and without affecting other customers.

4.4. You are responsible for any breach of this Section by your own customers, users or anyone else who uses the Services through your account, including under a reseller arrangement.

4.5. Breaches of this Section are handled under our Abuse Handling Policy.

5. Fair Use of Resources

5.1. Shared Hosting resources (CPU, RAM, I/O, processes, inodes, database connections and similar) are shared with other customers. Where a plan is described as "unlimited" or "unmetered", this means that we do not set a fixed limit for normal use of a personal or small business website. It does not mean unlimited use of physical resources.

5.2. If your account uses resources in a way that affects the stability or performance of the server or of other customers, we may throttle or temporarily restrict the account, ask you to optimise your project, or suggest an upgrade to a more suitable plan. Where the impact is serious, we may act first and inform you afterwards.

5.3. Shared Hosting must not be used as a file storage, backup or media distribution service unrelated to the websites you host.

6. Orders, Prices and Payment

6.1. All Services are provided on a prepaid basis. A Service is activated only after we have received full payment and completed any required verification. Activation usually takes up to 15 minutes, but in some cases (for example, manual checks or processing by a registry or certificate authority) it may take up to 12 hours.

6.2. Prices are shown on the Website and in the client area. Value Added Tax (VAT) is charged where required by the laws of the Republic of Cyprus and the European Union, depending on your location and status. Business customers in the EU may provide a valid VAT number to apply the reverse-charge mechanism where applicable. Fees charged by your bank or payment provider are your responsibility.

6.3. Automatic renewal. Services renew automatically for the same billing period unless you cancel them before the renewal date. We will issue a renewal invoice in advance. Where you have a saved payment method or funds on your account balance, it may be charged automatically on the due date.

6.4. Price changes. We may change our prices. New prices will apply from your next renewal, and we will notify you in advance. Promotional prices apply only to the first billing period unless stated otherwise.

6.5. Account balance. Funds added to your account balance can be used to pay for any Leneex Services. Account balance funds are not interest-bearing, cannot be transferred to another account and are not refundable or withdrawable as cash, except where required by applicable law.

6.6. Late payment. If an invoice is not paid by its due date, the Service may be suspended. If it remains unpaid, the Service may be terminated and the related data deleted permanently after the period stated in Section 11. Domain names not renewed on time may expire, enter a redemption period with additional fees charged by the registry, or become available to others.

6.7. Chargebacks and payment disputes. If you believe you have been charged incorrectly, please contact us first — most billing questions can be resolved within one business day. If a chargeback or payment dispute is opened without first contacting us, we may suspend all Services on your account until the matter is resolved, and charge any fees imposed on us by the payment provider. Chargebacks found to be unjustified or fraudulent may lead to permanent termination of the account. Details are set out in the Cancellation and Refund Policy.

7. Cancellation and Refunds

Cancellation of Services and refunds are governed by our Cancellation and Refund Policy. In short, because our Services are digital and are activated immediately after payment, payments for Services that have been delivered are not refundable, except in the limited cases described in that policy.

8. Service Availability and Support

8.1. We work to keep our Services available and reliable, and we monitor our infrastructure around the clock. However, we do not guarantee that the Services will be uninterrupted, error-free or completely secure.

8.2. We may carry out planned maintenance. Where possible, we will notify you in advance and schedule work so as to minimise disruption. Urgent maintenance (for example, to address a security vulnerability) may be carried out without prior notice.

8.3. Support is provided through the ticket system in the client area. Support covers the Services we provide and our infrastructure. It does not include the development, debugging or administration of your own software, websites or servers, unless this is included in your plan or agreed separately.

9. Intellectual Property

9.1. You keep all rights to your Customer Content. You grant us a limited licence to store, copy, transmit and process Customer Content only to the extent necessary to provide the Services, perform backups and comply with the law.

9.2. The Website, our brand, logos, software, documentation and all related materials belong to Leneex or its licensors. You may not use them without our prior written permission, except as necessary to use the Services.

10. Suspension

10.1. We may suspend all or part of the Services, with or without prior notice, if:

  • a) you breach these Terms or any of our policies;

  • b) an invoice remains unpaid after its due date;

  • c) we receive a credible abuse report, a court order or a request from a competent authority;

  • d) your account or server is compromised or poses a security risk to us, other customers or third parties;

  • e) your use of resources threatens the stability of our infrastructure;

  • f) a chargeback or payment dispute is opened;

  • g) you do not complete identity or payment verification when requested.

10.2. Where the situation allows, we will first contact you and give you a reasonable time to fix the issue. In cases of illegal activity, security threats or legal requirements, we may act immediately. Abuse reports are handled under the Abuse Handling Policy, under which the affected Service is suspended as soon as a report is confirmed.

10.3. When we restrict, suspend or remove a Service or content, we will inform you of the reasons for our decision and of the ways to contest it, as required by the EU Digital Services Act, unless a legal obligation or a competent authority prevents us from doing so.

10.4. Suspension does not stop billing. Fees for the suspended Service remain payable, and suspension does not give rise to any refund.

11. Termination

11.1. By you. You may cancel any Service at any time through the client area, in accordance with the Cancellation and Refund Policy.

11.2. By us. We may terminate any Service or your entire account:

  • a) for serious or repeated breaches of these Terms, including any use for illegal purposes, which will lead to termination of all Services and the entire account;

  • b) if a suspended Service is not paid, or the reason for suspension is not remedied, within 14 days of suspension;

  • c) if we are required to do so by law or by a competent authority;

  • d) with 30 days' notice for any other reason, in which case we will refund the unused portion of any prepaid fees for the terminated Service to your account balance.

11.3. Termination for breach does not give rise to any refund, including for prepaid periods or unused account balance.

11.4. Data after termination. After a Service ends, its data may be deleted permanently and cannot be recovered. We recommend that you download your data before cancelling. We are not obliged to keep, return or provide copies of Customer Content after termination, except where required by law.

11.5. Provisions which by their nature should continue to apply after termination (including those on payment, liability, indemnity and governing law) will survive termination.

12. Limitation of Liability

12.1. The Services are provided "as is" and "as available". To the maximum extent permitted by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose or non-infringement.

12.2. To the maximum extent permitted by law, Leneex will not be liable for:

  • a) loss of profits, revenue, business, goodwill or anticipated savings;

  • b) loss or corruption of data, including where you have not kept your own backups;

  • c) indirect, incidental, special or consequential losses;

  • d) losses caused by third parties, including registries, registrars, certificate authorities, payment providers, network operators and attackers;

  • e) losses resulting from your breach of these Terms or from the insecure configuration of your own software or servers.

12.3. To the maximum extent permitted by law, our total liability arising out of or in connection with the Services in any 12-month period is limited to the amount you actually paid to us for the affected Service during the three (3) months immediately before the event giving rise to the claim.

13. Indemnity

You agree to indemnify and hold harmless Leneex, its owners, staff and partners from any claims, losses, damages, fines, costs and expenses (including reasonable legal fees) arising from your Customer Content, your use of the Services, or your breach of these Terms or of applicable law.

14. Force Majeure

We are not responsible for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, fire, flood, epidemics, war, terrorism, civil unrest, government action, power failures, failures of third-party networks or data centres, large-scale cyberattacks, or actions of registries and upstream providers.

15. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes in our Services or in the law. The updated version will be published on the Website with a new "Last updated" date. For material changes we will notify you by e-mail or through the client area at least 14 days before they take effect. Your continued use of the Services after the changes take effect means that you accept the updated Terms.

16. Governing Law and Disputes

16.1. These Terms and any dispute or claim arising out of or in connection with them or the Services are governed by the laws of the Republic of Cyprus.

16.2. Before starting any legal proceedings, you agree to first try to resolve the matter with us through our Complaints Policy. Most issues can be resolved quickly this way.

16.3. If a dispute cannot be resolved within 60 days of your complaint, it shall be submitted to the exclusive jurisdiction of the competent courts of the Republic of Cyprus.

17. General

17.1. Entire agreement. These Terms, together with the policies referred to in them and your order, form the entire agreement between you and Leneex regarding the Services.

17.2. Severability. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions remain in full force and effect.

17.3. No waiver. Our failure to enforce any right or provision does not waive that right or provision.

17.4. Assignment. You may not transfer your account or your rights under these Terms without our written consent. We may assign our rights and obligations to an affiliate or to a successor of our business.

17.5. Notices. We may send notices to the e-mail address registered in your account or publish them in the client area. It is your responsibility to keep your e-mail address current and to read messages from us.

17.6. Language. These Terms are written in English. If they are translated, the English version prevails.
